Terms of Service

The short version

Buying Ombrelle gets you a license for life, including every future update, for one payment and no subscription. Payments are handled by Lemon Squeezy, our reseller and merchant of record. These Terms are governed by French law.

1. Who we are

Ombrelle is developed and published by Lionel Guichard ("we", "us", "our"), an individual publisher based in France. These Terms of Service ("Terms") govern your purchase and use of the Ombrelle macOS application ("Ombrelle") and this website. By downloading, activating a trial, or purchasing a license for Ombrelle, you agree to these Terms.

2. License grant

Subject to these Terms and payment of the applicable price, we grant you a personal, non-exclusive, non-transferable, revocable license to install and use Ombrelle on the number of Macs allowed by your license (its "seat limit", shown at checkout and in your license details). This is a license to use Ombrelle, not a sale of the software itself. We retain all ownership of it.

Your license is for the lifetime of the app: once purchased and activated, it does not expire, and it covers every future update released during that time at no extra cost (see "Updates" below). Your license key may be active on a limited number of devices at once; deactivating a device on your account frees that seat for another one.

3. Free trial

Ombrelle can be tried free for 7 days before you need a license. The trial unlocks the full app, and no account, email, or payment information is required to start it. Once the trial period ends, you need a valid license to keep using Ombrelle.

4. Purchases and payment

Ombrelle is sold as a one-time purchase, with no subscription and no App Store account involved. Checkout is handled by Lemon Squeezy, our reseller and merchant of record — they are the seller of record for this purchase, process your payment, and handle applicable sales tax/VAT; we never see or store your full card details ourselves. The displayed price may vary depending on your country and may change at any time, but a price change never affects a license you've already purchased.

Your license key is generated and delivered automatically once payment is confirmed. If you don't receive it, contact us at contact@ombrelle.app.

5. Refund policy

All sales are final. Because Ombrelle is digital software delivered to you immediately upon purchase, we do not offer refunds once a license key has been issued, except where required by law.

If you are a consumer purchasing from France or another European Union country, the law ordinarily gives you a 14-day right of withdrawal for online purchases. Digital content not supplied on a physical medium is exempt from this right once its delivery has begun with your prior express consent and express waiver of that right (Article L. 221-28, 13° of the French Consumer Code). By completing your purchase, you expressly request immediate delivery of your license and expressly waive your right of withdrawal accordingly. This doesn't affect the statutory warranties described below.

6. Statutory warranties

As a seller based in France, we remind you that goods and digital content sold to consumers remain covered by the legal warranty of conformity (Articles L. 217-3 and following of the French Consumer Code) and the warranty against hidden defects (Articles 1641 to 1648 of the French Civil Code). These statutory warranties apply in addition to, and are not limited by, the refund policy above.

7. Intellectual property

Ombrelle, including its source code, design, name, and icon, is the exclusive property of Lionel Guichard and is protected by copyright and other intellectual property laws. Your license lets you use the app; it doesn't transfer any ownership or intellectual property rights to you. You may not reverse-engineer, decompile, redistribute, resell, or sublicense Ombrelle, except to the extent applicable law expressly permits it despite this restriction.

8. Acceptable use

Your license key is yours to activate on the number of devices its seat limit allows. Sharing it beyond that, or attempting to bypass or circumvent Ombrelle's license or activation system, isn't permitted and may result in your license being disabled.

9. Updates

Ombrelle checks for updates automatically and installs them through Sparkle, an open-source update framework. Every update released during the lifetime of your license is included at no extra cost. We may add, change, or remove features in an update to keep improving the app.

10. Disclaimer of warranties

Other than the statutory warranties described above, Ombrelle is provided "as is" and "as available", without warranties of any kind, express or implied, including any warranty that it will be uninterrupted, error-free, or fit for a particular purpose beyond what it's described to do.

11. Limitation of liability

To the fullest extent permitted by law, our total liability arising from these Terms or your use of Ombrelle is limited to the amount you paid for your license, and we are not liable for indirect, incidental, or consequential damages such as lost data, lost profits, or business interruption. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under French law, including liability for gross negligence (faute lourde), willful misconduct (dol), or death or personal injury.

12. Governing law and jurisdiction

These Terms are governed by French law. Any dispute arising from these Terms or your use of Ombrelle that can't be resolved amicably will be submitted to the competent French courts, without prejudice to any mandatory right you have, as a consumer, to bring proceedings before the courts of your own country of residence within the European Union.

13. Changes to these Terms

We may update these Terms from time to time. If we do, we'll update the date at the top of this page. Continuing to use Ombrelle after a change means you accept the updated Terms.
